Collection, storage and processing of personal data

What information do we collect and for what purpose?
We collect and use personal data from our users only to the extent necessary to provide a functional website and our content and services. The collection and use of personal data from our users is generally only carried out with the user’s consent. An exception applies in cases where prior consent cannot be obtained for practical reasons and the processing of the data is permitted by law.

Description and scope of data processing:
Each time our website is accessed, our system automatically collects data and information from the computer system of the accessing computer.
For statistical purposes, we store the name of the requested website, the date and time of the page view, and the amount of data transferred. In addition, we store whether the transfer of information was successful and which provider was used to access the site.

The data is also stored in our system’s log files. This data is not stored together with other personal data relating to the user.
The temporary storage of the IP address by the system is necessary to enable the website to be delivered to the user’s computer. For this purpose, the user’s IP address must remain stored for the duration of the session.

Google Maps:

Our websites use Google Maps to display maps and create route plans. Google Maps is operated by Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. By using this website, you consent to the collection, processing and use of automatically collected data and data entered by you by Google, one of its representatives or third-party providers. If you provide us with your email address, we will communicate with you via email. However, we will not pass this address on to third parties outside Kalzip GmbH. KG. If personal data is transmitted to us depending on the settings of your email programme, we will treat this data as confidential. The information transmitted within the information exchange is not encrypted.

If you fill out a registration form with contact information (‘CONTACT’) on our website, this information will be used to send you the requested responses, product information, news, etc. Your personal data will be used exclusively for these purposes and will not be passed on to third parties outside Kalzip GmbH. The data you send us online is not encrypted. The legal basis for this data processing is your conclusive consent as declared during the sending process in accordance with Art. 6 (1) (a) GDPR. This data will be deleted as soon as it is no longer required for the purpose for which it was collected. As a user, you have the option of cancelling your registration at any time. You can have the data stored about you changed at any time.

Google Fonts:

Our website uses external fonts, Google Fonts. Google Fonts is a service provided by Google Inc. (‘Google’). These web fonts are integrated via a server call, usually a Google server in the USA. This transmits to the server which of our web pages you have visited. Google also stores the IP address of the browser on the visitor’s device. Google Analytics:

Google Analytics is a service provided by Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (‘Google’). Google Analytics uses ‘cookies’, which are text files placed on your computer, to help the website analyse how users use the site. The information generated by the cookie about your use of our website (including your IP address) is usually transferred to a Google server in the USA and stored there. We would like to point out that on our websites, Google Analytics has been extended by the code ‘gat._anonymizeIp();;’ to ensure anonymous collection of IP addresses (so-called IP masking). At our request, Google therefore only records your IP address in truncated form, which ensures anonymisation and does not allow any conclusions to be drawn about your identity. Newsletter

On our website, you have the option of subscribing to a free newsletter. When you register for the newsletter, the data from the input mask is transmitted to us.
At this point, the specific data collected should be mentioned. At a minimum, this includes the user’s email address.

In addition, the following data is collected during registration:
• IP address of the accessing computer
• Date and time of registration

For the processing of data, your consent will be obtained during the registration process and reference will be made to this privacy policy.

In connection with data processing for the purpose of sending newsletters, no data will be passed on to third parties. The data will be used exclusively for sending the newsletter.

Purpose of data processing in connection with sending newsletters:

The user’s email address is collected for the purpose of delivering the newsletter. The newsletter is sent on the basis of the user’s registration on the website. The collection of other personal data during the registration process serves to prevent misuse of the services or the email address used.

Duration of storage with regard to data collected for the use of newsletters:

The data will be deleted as soon as it is no longer required for the purpose for which it was collected. The user’s email address will therefore be stored for as long as the newsletter subscription is active.
The newsletter is sent on the basis of the user’s registration on the website.

Other personal data collected during the registration process will generally be deleted after a period of seven days.

Option to object to and unsubscribe from the newsletter:

The newsletter subscription can be cancelled by the user concerned at any time. For this purpose, each newsletter contains a corresponding unsubscribe link.

Storage period and data deletion

The personal data of the data subject will be deleted or blocked as soon as the purpose of storage no longer applies. Storage may also take place if this has been provided for by European or national legislators in EU regulations, laws or other provisions to which the controller is subject. The data will also be blocked or deleted if a storage period prescribed by the aforementioned standards expires, unless there is a need for further storage of the data for the conclusion or fulfilment of a contract.

Other data will also be deleted as soon as it is no longer required for the purpose for which it was collected. In the case of data collected for the provision of the website, this is the case when the respective session has ended.

If the data is stored in log files, it will be deleted after seven days at the latest. Storage beyond this period is possible. In this case, the IP addresses of the users will be deleted or anonymised so that it is no longer possible to identify the accessing client.

Our website uses cookies. Cookies are text files that are stored in the internet browser or by the internet browser on the user’s computer system. When a user accesses a website, a cookie may be stored on the user’s operating system. Legal basis for the processing of personal data

Insofar as we obtain the consent of the data subject for the processing of personal data, Article 6(1)(a) of the EU General Data Protection Regulation (GDPR) serves as the legal basis for the processing of personal data.

When processing personal data that is necessary for the performance of a contract to which the data subject is party, Article 6(1)(b) GDPR serves as the legal basis. This also applies to processing operations that are necessary for the implementation of pre-contractual measures.

Insofar as the processing of personal data is necessary to fulfil a legal obligation to which our company is subject, Article 6(1)(c) GDPR serves as the legal basis.

In the event that vital interests of the data subject or another natural person require the processing of personal data, Article 6(1)(d) GDPR serves as the legal basis.

If processing is necessary to safeguard a legitimate interest of our company or a third party, and if the interests, fundamental rights and freedoms of the data subject do not override the former interest, Art. 6 para. 1 lit. f GDPR serves as the legal basis for processing.

The legal basis for the temporary storage of data and log files is Article 6(1)(f) GDPR.

In accordance with Art. 15 in conjunction with § 34 BDSG, you have the unrestricted right to obtain information free of charge about your data stored by us and, in accordance with § 35 BDSG, the right to have inadmissible data deleted or blocked or the right to have incorrect data corrected.

Upon request, we will be happy to inform you in writing whether and what personal data we have stored about you. As far as possible, we will take appropriate measures to update or correct your data stored with us at short notice. Please send all requests for information, enquiries or objections to data processing directly to our data protection officer by e-mail, stating your full postal address.

If your personal data is processed, you are a data subject within the meaning of the GDPR and you have the following rights vis-à-vis the controller:

Right to information:

You may request confirmation from the controller as to whether personal data concerning you is being processed by us.

If such processing takes place, you may request the following information from the controller:
• the purposes for which the personal data are processed;
• the purposes for which the personal data are processed;
• the recipients or categories of recipients to whom your personal data has been or will be disclosed;
• the planned duration of storage of the personal data concerning you or, if specific information on this is not possible, criteria for determining the storage period;
• the existence of a right to rectification or erasure of personal data concerning you, a right to restriction of processing by the controller or a right to object to such processing;
• the existence of a right to lodge a complaint with a supervisory authority;
• all available information on the origin of the data, if the personal data is not collected from the data subject;
• the existence of automated decision-making, including profiling, referred to in Article 22(1) and (4) of the GDPR and, at least in those cases, meaningful information about the logic involved, as well as the significance and the envisaged consequences of such processing for the data subject.
• You have the right to request information about whether personal data concerning you is being transferred to a third country or to an international organisation. In this context, you may request to be informed about the appropriate safeguards pursuant to Article 46 GDPR in connection with the transfer.

Right to rectification:

You have the right to request the controller to correct and/or complete your personal data if it is inaccurate or incomplete. The controller must make the correction without delay.

Right to restriction of processing:

You may request the restriction of the processing of personal data concerning you under the following conditions:

• if you dispute the accuracy of the personal data concerning you for a period enabling the controller to verify the accuracy of the personal data;
• the processing is unlawful and you oppose the erasure of the personal data and request the restriction of their use instead;
• the controller no longer needs the personal data for the purposes of the processing, but you require it for the establishment, exercise or defence of legal claims; or
• you have objected to processing pursuant to Article 21(1) of the GDPR and it is not yet clear whether the legitimate grounds of the controller override your grounds.

Where the processing of personal data concerning you has been restricted, such data may, with the exception of storage, only be processed with your consent or for the establishment, exercise or defence of legal claims or for the protection of the rights of another natural or legal person or for reasons of important public interest of the Union or of a Member State.

If the processing has been restricted in accordance with the above conditions, you will be informed by the controller before the restriction is lifted.

Right to erasure:

You may request that the controller delete your personal data without delay, and the controller is obliged to delete this data without delay if one of the following reasons applies:

• The personal data concerning you is no longer necessary for the purposes for which it was collected or otherwise processed.
• You withdraw your consent on which the processing was based in accordance with Art. 6(1)(a) or Art. 9(2)(a) GDPR, and there is no other legal basis for the processing.
• You object to the processing pursuant to Article 21(1) GDPR and there are no overriding legitimate grounds for the processing, or you object to the processing pursuant to Article 21(2) GDPR.
• The personal data concerning you has been processed unlawfully.
• The deletion of personal data concerning you is necessary to comply with a legal obligation under Union law or the law of the Member States to which the controller is subject.
• The personal data concerning you was collected in relation to the services offered by the information society in accordance with Article 8(1) of the GDPR.

If the controller has made the personal data concerning you public and is obliged to erase it in accordance with Article 17(1) of the GDPR, it shall take reasonable steps, including technical measures, taking into account the available technology and implementation costs, to inform controllers who process the personal data that you, as the data subject, have requested them to delete all links to this personal data or copies or replications of this personal data.

The right to erasure does not apply if processing is necessary:

• to exercise the right of freedom of expression and information;
• to comply with a legal obligation which requires processing under Union or Member State law to which the controller is subject, or to perform a task carried out in the public interest or in the exercise of official authority vested in the controller;
• for reasons of public interest in the area of public health pursuant to Art. 9(2)(h) and (i) and Art. 9(3) GDPR;
• for archiving purposes in the public interest, scientific or historical research purposes or statistical purposes pursuant to Art. 89(1) GDPR, insofar as the right referred to in section a) is likely to render impossible or seriously impair the achievement of the objectives of this processing, or
• for the establishment, exercise or defence of legal claims.

If you have exercised your right to rectification, erasure or restriction of processing against the controller, the controller is obliged to notify all recipients to whom your personal data has been disclosed of this rectification or erasure of the data or restriction of processing, unless this proves impossible or involves disproportionate effort.

You have the right to be informed by the controller about these recipients.

You have the right to receive the personal data concerning you that you have provided to the controller in a structured, commonly used and machine-readable format. You also have the right to transmit this data to another controller without hindrance from the controller to whom the personal data was provided, provided that

• the processing is based on consent pursuant to Art. 6(1)(a) GDPR or Art. 9(2)(a) GDPR or on a contract pursuant to Art. 6(1)(b) GDPR, and
• processing is carried out using automated means.

In exercising this right, you also have the right to have the personal data concerning you transferred directly from one controller to another controller, where technically feasible. This must not adversely affect the freedoms and rights of other persons.

The right to data portability does not apply to the processing of personal data necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller.

Right to object and revoke:

You have the right to object at any time, on grounds relating to your particular situation, to the processing of personal data concerning you which is carried out on the basis of Article 6(1)(e) or (f) of the GDPR; this also applies to profiling based on these provisions.

The controller shall no longer process the personal data concerning you unless the controller can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms or for the establishment, exercise or defence of legal claims.

If your personal data is processed for direct marketing purposes, you have the right to object at any time to the processing of your personal data for such marketing purposes; this also applies to profiling insofar as it is related to such direct marketing.

If you object to processing for direct marketing purposes, the personal data concerning you will no longer be processed for these purposes.

You have the option, in relation to the use of information society services – notwithstanding Directive 2002/58/EC – to exercise your right to object by means of automated procedures using technical specifications.

You have the right to revoke your declaration of consent under data protection law at any time. Revoking your consent does not affect the legality of the processing carried out on the basis of your consent prior to revocation. Right to object and right to erasure.

If you contact us by email, you can object to the storage of your personal data at any time. In such a case, the conversation cannot be continued.

All personal data stored in the course of establishing contact will be deleted in this case.

The collection of data for the provision of the website and the storage of data in log files is essential for the operation of the website. Consequently, there is no possibility of objection in this regard.

Right to lodge a complaint with a supervisory authority:

Without prejudice to any other administrative or judicial remedy, you have the right to lodge a complaint with a supervisory authority, in particular in the Member State of your habitual residence, place of work or place of the alleged infringement, if you consider that the processing of personal data relating to you infringes the GDPR.

The supervisory authority to which the complaint has been lodged shall inform the complainant of the progress and outcome of the complaint, including the possibility of a judicial remedy pursuant to Article 78 of the GDPR.
